The Constitutional Court of the Republic of Bulgaria has admitted for consideration on the merits Constitutional Case No. 9/2026 concerning the constitutionality of § 5, Paragraph 1 of the Transitory and Concluding Provisions of the 2025 State Budget Act.

The challenged provision introduces an additional financial obligation for concessionaires holding concession agreements for the extraction of underground resources. The case raises important questions regarding the constitutional principles of the rule of law, legality of public charges, freedom of economic initiative and protection of property rights.
