Recent matters DGKV’s Insolvency & Restructuring team has worked on include:

• Acting as co-counsel to The State General Reserve Fund of the Sultanate of Oman in an investment arbitration case against the Republic of Bulgaria before the International Centre for Settlement of Investment Disputes, Washington D.C. in relation to the termination of the bank license of Corporate and Commercial Bank AD and the consequent bank insolvency proceedings before the competent Bulgarian courts.
• Advising Blantyre Capital Limited, BlackRock, EBRD, and the Bulgarian Development Bank on the restructuring of Bulsatcom EAD, the leading satellite TV provider in Bulgaria.
• Advising Accreda Management AG, Switzerland in bankruptcy proceedings against a Bulgarian debtor.
• Advising Andres Schneider Rechtsanwaelte in a series of cases, including one in which the Supreme Court of Cassation found it necessary to make a reference for a preliminary ruling to the European Court of Justice requiring interpretation of the provisions of Council Regulation (EC) No 1346/2000 of 29th May 2000 on insolvency proceedings.
• Assisting Arcelor a.s. in the bankruptcy procedure of Kremikovtsi AD.
• Assisting Arcelor Mittal S.A. as creditor in the insolvency proceedings of Finmetals AD.
• Advising Blue Crest Mercantile Fund on the restructuring of a secured forward purchase of a trade finance facility and subsequent reorganization following the bankruptcy of a Bulgarian company.
• Assisting Cargill Bulgaria in insolvency proceedings.
• Representing CEZ Electro Bulgaria AD before the Sofia City Court in a lawsuit initiated by a renewable-power energy producer claiming CEZ’s insolvency.
• Advising Daewoo International Corporation in bankruptcy proceedings against a Bulgarian company.
• Representing Exportní Garanční a Pojišt’ovací Společnost a.s. in its capacity as a joined creditor in bankruptcy proceedings as well as in a number of avoidance actions brought against third parties with regard to the collection of over EUR 3 million debt.
• Advising Marie Brizard Wine & Spirits SA in insolvency proceedings launched against two of its Bulgarian subsidiaries in Bulgarian courts.
• Assisting Punto FA S.L. with its defense of a EUR 9 million invalidation claim involving a cross-border insolvency.
• Assisting Dow AgroSciences S.A. with insolvency proceedings it initiated against a Bulgarian debtor-company, in a case that settled out of court.
